<div data-element-id="elm_GMMpn0pZT3us4QHY0QyV3Q" data-element-type="text" class="zpelement zpelem-text "><style></style><div class="zptext zptext-align-center " data-editor="true"><div><p style="text-align:left;margin-bottom:24px;font-size:18px;"><span style="color:rgb(0, 0, 0);">The&nbsp;<a href="https://globalnews.ca/tag/federal-court">Federal Court</a>&nbsp;has launched a pilot project to streamline the judicial review of rejected student visa applications.</span></p><div style="text-align:left;"><span style="color:rgb(0, 0, 0);font-size:18px;">The pilot is called the Study Permit Pilot Project. <span style="font-weight:bold;">Under this program, the court promises that those who apply for a judicial review of their rejected student visa will receive a resolution in five months instead of the usual 14 to 18 months.</span></span><br></div><p style="text-align:left;margin-bottom:24px;font-size:18px;"><span style="color:rgb(0, 0, 0);">Federal Court Chief Justice Paul Crampton said the pilot project will not require a hearing and will allow judges to rule on leave and judicial review simultaneously.</span></p><p style="text-align:left;margin-bottom:24px;font-size:18px;"><span style="color:rgb(0, 0, 0);">“This will be a win-win for applicants, who will save significant time and costs, and for the Court, which will save scarce judicial and registry resources,” he said in a statement.</span></p></div></div>
</div><div data-element-id="elm_ue7evz8tqODGUId4DTMEVA" data-element-type="text" class="zpelement zpelem-text "><style></style><div class="zptext zptext-align-left " data-editor="true"><div><h2 style="margin-bottom:15px;font-weight:700;font-size:32px;"><span style="color:rgb(0, 0, 0);">Who is eligible?</span></h2><p style="margin-bottom:16px;font-size:19px;"><span style="color:rgb(0, 0, 0);">Students may be eligible for the Study Permit Pilot Project if they applied for a study permit, and received a letter of refusal from&nbsp;<a href="https://www.canadavisa.com/ircc.html">Immigration, Refugees and Citizenship Canada (IRCC)</a>. Other criteria include:</span></p><ul><li style="margin-bottom:11px;"><span style="color:rgb(0, 0, 0);">Both the prospective student (the Applicant) and IRCC opting in to the pilot project;</span></li><li style="margin-bottom:11px;"><span style="color:rgb(0, 0, 0);">Both parties agreeing on the underlying facts, as evidenced by the application materials submitted to IRCC by the Applicant, including the full reasons for the IRCC decision;</span></li><li style="margin-bottom:11px;"><span style="color:rgb(0, 0, 0);">The facts/issues of the case—either the initial study permit application, the refusal from IRCC, or both—being straightforward (e.g. no factual or legal issues of inadmissibility or national security and no request for a certified question);</span></li><li style="margin-bottom:11px;"><span style="color:rgb(0, 0, 0);">The applicant not needing to request an extension of time to file the Application for Leave;</span></li><li style="margin-bottom:11px;"><span style="color:rgb(0, 0, 0);">The parties not using affidavit evidence (affidavits are used to introduce new evidence, which is not permitted under this new pilot project)</span></li></ul><p style="margin-bottom:16px;font-size:19px;"><span style="color:rgb(0, 0, 0);">Study permit applicants applying from within Canada, have 15 days from the day they received their study permit application refusal to apply under this new initiative. Applicants applying from outside Canada, have 60 days from the day they receive their study permit application refusal to apply.</span></p><h2 style="margin-bottom:15px;font-weight:700;font-size:32px;"><span style="color:rgb(0, 0, 0);">How to apply</span></h2><p style="margin-bottom:16px;font-size:19px;"><span style="color:rgb(0, 0, 0);">All documents have to be filed online using the court’s electronic filing system. To opt in, applicants have to file an application for Leave and Judicial Review using Form IR-1,and mention the Pilot Project in three specific places of the application. Starting in January&nbsp;2023, through a temporary 2-year measure, Canada will expand eligibility to work in Canada to spouses and working-age children through a phased approach for workers at all skill levels. The program will triple from 32 seats to 96 seats by March 2024.</span></p><p><span>(PRA-BC) program provides an alternative pathway to licensure in B.C. for practicing family doctors from jurisdictions outside of Canada. After successfully completing an assessment, physicians receive a provisional license and are positioned for a three-year return of service in a community of identified need.&nbsp;</span></p><p style="margin-bottom:7.5pt;"><span>Also, International medical graduates (IMGs) who are not eligible for full or provisional licensure in B.C. may be eligible for a new associate physician class of restricted registration with the College of Physicians and Surgeons of BC (CPSBC).&nbsp;</span></p><p><span>Currently, internationally educated doctors who want to work in B.C. need to meet the minimum national medical standards for practise and successfully complete a series of assessments identified by national and provincial regulatory bodies to allow for registration with the CPSBC. The new class allows practitioners with specialty medical training that is acceptable to the CPSBC to work under physician direction and supervision within a health authority acute-care setting to increase capacity and service delivery.</span></p><p><span>The new associate physician classification will support IMGs in the province who are not eligible for licensure as independent medical practitioners to find employment opportunities that meet priority health-system gaps.</span></p><p style="margin-bottom:7.5pt;"><span>This will allow them to care for patients under the direction and supervision of an attending physician within a health authority acute-care setting. This is part of government’s work to recruit more health professionals and provide immediate solutions for people who need to access health services.&nbsp;</span></p><p style="margin-bottom:7.5pt;"><span>The Ministry of Health is also working with the CPSBC to expand the new class, so associate physicians can work in community-based primary care settings over the coming months.</span></p><p style="margin-bottom:7.5pt;"><span>The Province is working with the Royal College of Physicians and Surgeons of Canada&nbsp;and the College of Family Physicians of Canada to allow IMGs to start the accreditation process before they arrive in B.C. Doctors interested in moving to B.C. will have increased certainty of being able to practise when they arrive, so they can support doctors and begin treating patients.</span></p><p style="margin-bottom:7.5pt;"><span>The College of Physicians and Surgeons of BC will prepare bylaw changes to allow doctors trained in the U.S. for three years to&nbsp;practise medicine in community settings, such as&nbsp;urgent and primary care centres, community clinics and family practices.
