<div data-element-id="elm_GMMpn0pZT3us4QHY0QyV3Q" data-element-type="text" class="zpelement zpelem-text "><style></style><div class="zptext zptext-align-center " data-editor="true"><div><p style="text-align:left;margin-bottom:24px;font-size:18px;"><span style="color:rgb(0, 0, 0);">The&nbsp;<a href="https://globalnews.ca/tag/federal-court">Federal Court</a>&nbsp;has launched a pilot project to streamline the judicial review of rejected student visa applications.</span></p><div style="text-align:left;"><span style="color:rgb(0, 0, 0);font-size:18px;">The pilot is called the Study Permit Pilot Project. <span style="font-weight:bold;">Under this program, the court promises that those who apply for a judicial review of their rejected student visa will receive a resolution in five months instead of the usual 14 to 18 months.</span></span><br></div><p style="text-align:left;margin-bottom:24px;font-size:18px;"><span style="color:rgb(0, 0, 0);">Federal Court Chief Justice Paul Crampton said the pilot project will not require a hearing and will allow judges to rule on leave and judicial review simultaneously.</span></p><p style="text-align:left;margin-bottom:24px;font-size:18px;"><span style="color:rgb(0, 0, 0);">“This will be a win-win for applicants, who will save significant time and costs, and for the Court, which will save scarce judicial and registry resources,” he said in a statement.</span></p></div></div>
</div><div data-element-id="elm_ue7evz8tqODGUId4DTMEVA" data-element-type="text" class="zpelement zpelem-text "><style></style><div class="zptext zptext-align-left " data-editor="true"><div><h2 style="margin-bottom:15px;font-weight:700;font-size:32px;"><span style="color:rgb(0, 0, 0);">Who is eligible?</span></h2><p style="margin-bottom:16px;font-size:19px;"><span style="color:rgb(0, 0, 0);">Students may be eligible for the Study Permit Pilot Project if they applied for a study permit, and received a letter of refusal from&nbsp;<a href="https://www.canadavisa.com/ircc.html">Immigration, Refugees and Citizenship Canada (IRCC)</a>. Other criteria include:</span></p><ul><li style="margin-bottom:11px;"><span style="color:rgb(0, 0, 0);">Both the prospective student (the Applicant) and IRCC opting in to the pilot project;</span></li><li style="margin-bottom:11px;"><span style="color:rgb(0, 0, 0);">Both parties agreeing on the underlying facts, as evidenced by the application materials submitted to IRCC by the Applicant, including the full reasons for the IRCC decision;</span></li><li style="margin-bottom:11px;"><span style="color:rgb(0, 0, 0);">The facts/issues of the case—either the initial study permit application, the refusal from IRCC, or both—being straightforward (e.g. no factual or legal issues of inadmissibility or national security and no request for a certified question);</span></li><li style="margin-bottom:11px;"><span style="color:rgb(0, 0, 0);">The applicant not needing to request an extension of time to file the Application for Leave;</span></li><li style="margin-bottom:11px;"><span style="color:rgb(0, 0, 0);">The parties not using affidavit evidence (affidavits are used to introduce new evidence, which is not permitted under this new pilot project)</span></li></ul><p style="margin-bottom:16px;font-size:19px;"><span style="color:rgb(0, 0, 0);">Study permit applicants applying from within Canada, have 15 days from the day they received their study permit application refusal to apply under this new initiative. Applicants applying from outside Canada, have 60 days from the day they receive their study permit application refusal to apply.</span></p><h2 style="margin-bottom:15px;font-weight:700;font-size:32px;"><span style="color:rgb(0, 0, 0);">How to apply</span></h2><p style="margin-bottom:16px;font-size:19px;"><span style="color:rgb(0, 0, 0);">All documents have to be filed online using the court’s electronic filing system. To opt in, applicants have to file an application for Leave and Judicial Review using Form IR-1,and mention the Pilot Project in three specific places of the application. <div data-element-id="elm_Xl0uXAhpSd-ES2xWiAXxiQ" data-element-type="text" class="zpelement zpelem-text "><style></style><div class="zptext zptext-align-center " data-editor="true"><div><p style="text-align:left;font-size:18px;"><span style="color:rgb(0, 0, 0);">As of September 30, 2024, candidates must submit a Worker Expression of Interest (EOI) if they are interested in receiving an invitation to apply to one of the Alberta Advantage Immigration Program’s (AAIP’s) worker streams.&nbsp;</span></p><p style="text-align:left;font-size:18px;"><span style="color:rgb(0, 0, 0);">There is no fee to submit a Worker&nbsp;.</span></p><p style="text-align:left;font-size:18px;"><span style="color:rgb(0, 0, 0);">Candidates will self-declare information about themselves through an online Worker EOI form in the AAIP portal. Each Worker EOI will be scored and ranked using the&nbsp;<a href="https://www.alberta.ca/system/files/im-worker-stream-expression-of-interest-points-grid.pdf" target="_blank" id="d844fa72-a9c7-4845-9051-5da5d11623ce">Worker EOI points grid</a>. Candidates who successfully submit a Worker EOI will be placed into the Worker Stream pool to be considered for selection.</span></p><p style="text-align:left;font-size:18px;"><span style="color:rgb(0, 0, 0);">The AAIP will conduct ongoing draws from the Worker Stream pool for specific worker streams and pathways. The AAIP will select and invite candidates from the Worker Stream pool based on candidate EOI score rankings and provincial labour market needs and priorities, available AAIP nominations, and application levels. Individuals who are selected will receive an invitation to apply by email.</span></p><p style="text-align:left;font-size:18px;"><span style="color:rgb(0, 0, 0);font-weight:bold;">It is important to note that while the new system will be available on September 30, 2024 at 10 am, there is no need to rush to submit a Worker EOI as the AAIP will not conduct draws from the Worker Stream pool until mid or late October 2024.</span></p></div></div>

 class="zpheading zpheading-style-type1 zpheading-align-left " data-editor="true"><span style="color:inherit;font-size:16px;">The Honourable Sean Fraser, Minister of Immigration, Refugees, and Citizenship, <a href="https://www.canada.ca/en/immigration-refugees-citizenship/news/2023/06/canadas-tech-talent-strategy.html#:%7E:text=The%20Government%20of%20Canada%20is%20embracing%20Canada%E2%80%99s%20emerging%20role%20as%20a%20leader%20in%20global%20tech%20talent%20recruitment" title="announced an approach" rel="">announced an approach</a> that includes four key pillars involving additions and improvements to programs offered by Immigration, Refugees and Citizenship Canada (IRCC).</span><br><span style="color:inherit;font-size:16px;">​</span><span style="font-size:16px;">Thousands of workers in high-tech fields are employed with companies that have large operations in both Canada and the US, and those working in the US often hold an H-1B specialty occupation visa.</span><div style="color:inherit;"><div><span style="font-size:16px;"><span style="font-weight:bold;">As of July 16, 2023, H-1B specialty occupation visa holders in the US, and their accompanying immediate family members, will be eligible to apply to come to Canada</span>.</span></div><div><span style="font-size:16px;"><span style="font-weight:bold;text-decoration-line:underline;">Approved applicants will receive an open work permit of up to three years in duration,</span> which means they will be able to<span style="font-weight:bold;"> work for almost any employer anywhere in Canada.</span> Their <span style="text-decoration-line:underline;">spouses and dependants will also be eligible to apply for a temporary resident visa, with a work or study permit, as needed.</span></span></div><div><span style="font-size:16px;">This will expand the opportunities available for skilled workers to continue to pursue their careers in the high-tech sector and contribute to economic growth and prosperity in North America.</span></div><div><span style="font-size:16px;">This measure will remain in effect for one year, or until IRCC receives 10,000 applications.
