Who is eligible?

Students may be eligible for the Study Permit Pilot Project if they applied for a study permit, and received a letter of refusal from Immigration, Refugees and Citizenship Canada (IRCC). Other criteria include:

• Both the prospective student (the Applicant) and IRCC opting in to the pilot project;
• Both parties agreeing on the underlying facts, as evidenced by the application materials submitted to IRCC by the Applicant, including the full reasons for the IRCC decision;
• The facts/issues of the case—either the initial study permit application, the refusal from IRCC, or both—being straightforward (e.g. no factual or legal issues of inadmissibility or national security and no request for a certified question);
• The applicant not needing to request an extension of time to file the Application for Leave;
• The parties not using affidavit evidence (affidavits are used to introduce new evidence, which is not permitted under this new pilot project)

Study permit applicants applying from within Canada, have 15 days from the day they received their study permit application refusal to apply under this new initiative. Applicants applying from outside Canada, have 60 days from the day they receive their study permit application refusal to apply.

How to apply

All documents have to be filed online using the court’s electronic filing system. To opt in, applicants have to file an application for Leave and Judicial Review using Form IR-1,and mention the Pilot Project in three specific places of the application. More details can be found here.

After filing documents, a judge will decide on the application and notify the applicant.

We encourage you to take the following steps to prepare to submit a Worker EOI:

• Confirm you meet eligibility requirements for one or more AAIP worker streams.
• Review the Worker EOI points grid to understand the type of information we will be collecting in the Worker EOI and how points are awarded.
• Consider your existing AAIP applications or Entrepreneur EOIs.
  • You can only have one Worker EOI.
  • You cannot create a Worker EOI if you have an existing Worker EOI or Entrepreneur EOI or a draft or active AAIP application. Existing applications or EOIs must be withdrawn prior to creating a Worker EOI.
• Make sure you have a valid, basic Alberta.ca Account. You may use an existing basic or verified Alberta.ca Account.

International Students in Canada will be now allowed to work up to 24 hours per week which is an increase of 4 hrs/week from the current limit of 20 hrs. Immigration Minister Marc Miller made this announcement earlier in April. He stated that the new 24-hour cap "strikes the appropriate balance so students have the option to work without compromising academic outcomes " 

It is worth notifying that Off-campus work includes areas outside the educational institution and its campus, including self-employment options like Uber or door Dash deliveries. Also students have no limit on hours that they can work during the scheduled breaks, such as summer or winter holidays.

• have accumulated, within the past 3 years, at least 6 months of continuous work experience (in Canada or abroad) in a single occupation listed in the table below
• meet all of the requirements in the instructions for that round
